Callahan, Nick

Nick is an associate at Gray Plant Mooty and member of the Litigation practice group. He focuses his practice on complex business litigation at the trial and appellate levels in federal and state courts.

Nick has represented clients in a broad range of industries, including banks, private equity firms, real estate investors and developers, including those organized as REITs, domestic and foreign manufacturers, automobile companies, American subsidiaries of foreign companies, national retailers, franchisors, healthcare companies, and directors and officers of companies who have been sued in an individual capacity. He has represented these clients in a variety of disputes, including general contract disputes, disputes governed by the UCC, professional liability claims, various tort claims, commercial mortgage foreclosures and other creditors’ rights matters, employment law matters, and class action claims.

Nick has appeared in federal and state courts in several states and has experience in international litigation, including litigation involving courts in Great Britain and India. His international experience also includes living abroad and traveling to more than 25 countries.

Before joining Gray Plant Mooty, Nick worked as a litigation associate at a Chicago law firm.

Experience

  • Represented a real estate investment company in a contract dispute concerning an investment deal; Successfully argued a motion for summary judgment on the complaint filed on behalf of client
  • Represented a bank sued by a customer seeking to represent a class of those similarly situated.  Successfully argued several motions, including successfully opposing a motion by the plaintiff who sought costly discovery from the bank before the court ruled on the bank’s motion to dismiss the lawsuit
  • Represented a health care company in arbitration against the seller of a company it purchased concerning indemnification and the purchase agreement’s earn-out provision
  • Represented an SEC-appointed receiver of a registered investment adviser, who was appointed after the embezzlement by a principal of the adviser of over $50 million of client assets, in various lawsuits filed by the receiver
  • Represented a parent company and its officers who were sued for tens of millions of dollars under a variety of contract and tort theories by two companies that entered into a joint venture with of one of the parent company’s subsidiaries, after many of the asset based loans made by the joint venture defaulted during the 2008 economic crash
  • Represented a foreign manufacturer of automobile parts against breach of warranty and other contractual claims alleged by its former American distributor
  • Represented a number of banks in commercial mortgage foreclosures involving outstanding loans in amounts as high as eight figures; Successfully argued various motions to defeat tactics by borrowers to delay foreclosure
  • Represented a number of banks in lawsuits concerning personal guarantees by real estate developers for commercial real estate loans
  • Represented several franchisors in terminating franchisees
  • Represented clients in litigation concerning fraudulent conveyances and other creditor remedies
  • Acted as local counsel for a national retail chain in an employment law case
