
Ed is a principal at Gray Plant Mooty, cochair of the firm’s Real Estate practice group and concentrates his practice in construction law, alternative dispute resolution, and land use matters. Ed’s construction practice includes the negotiation and preparation of contracts for design professionals and contractors, representation of parties through the construction project including assisting them with changes to the construction contract, performance issues, claims for extras, and defective construction claims. He represents parties in all phases of dispute resolution including mediation, arbitration, and trials. Ed also has substantial experience in mechanic’s lien and bond claims. His clients include owner/developers, design professionals, general contractors, and subcontractors. He has also represented clients in the Minnesota Tax Court in real estate tax litigation matters. Ed has personally participated in the development of commercial, single- and multifamily real estate projects.
Ed has completed advanced training and actively serves as an arbitrator and mediator on the American Arbitration Association’s construction and commercial law panels. He has spoken at industry and continuing legal education seminars on various construction law, alternative dispute resolution, and real estate tax law topics.
Ed has been an attorney with Gray Plant Mooty since 1978. He was the managing principal of the St. Cloud office from 1988-2000, is currently its managing officer and is on the firm’s Board of Directors.
Experience
- Represents national producer of aggregate materials in land use, permitting, and litigation matters
- Represented two Minnesota municipalities in appeals of conditional use permit and NPDES permit issues
- Represented a general contractor in a multimillion dollar, multifamily project in which the owner claimed that defective construction of the projects' mechanical systems led to mold
- Recently represented design professionals in claims regarding mold and defective structural design issues
