Our approach to compliance reviews combines our legal expertise and perspective with a practical business viewpoint. We candidly review the strengths and weaknesses of your current practices and policies, identify any risk areas, and provide constructive recommendations.  Each compliance review in our series is offered at a customized flat rate with a comprehensive evaluation of your company’s policies, practices, and procedures.

Just as you need a regular physical to make sure everything is in working order, your group health plan could probably use a check-up.  Our approach combines our legal expertise and perspective with a practical business viewpoint.  Your compliance review will be tailored to your needs, and may include the following:

  • An introductory meeting with selected business, employee benefits, or HR leaders
     
  • A review of your group health plan documents, administrator or vendor contracts, and your policies and procedures governing group health plans.  Depending on your benefits program, your review may cover compliance with the following laws:
    • ERISA—documentation, reporting, disclosure to participants
       
    • HIPAA—privacy of protected health information, certificates of creditable coverage, training materials, special enrollment
       
    • COBRA—notices, election periods, coverage, open enrollment
       
    • GINA, ADA, and HIPAA requirements applicable to wellness plans
       
    • Health Care Reform—“grandfather” status, eligibility of full-time employees, medical loss ratio rebates, nondiscrimination, required coverage, appeals process, waiting periods, reporting and disclosure
       
  • A review of your Section 125 “Cafeteria” or “Flexible Benefits” Plan for compliance with Internal Revenue Code and, where applicable, ERISA.
     
  • A written summary of the results of your compliance review, with specific recommendations tailored to your situation.
