Tim’s practice includes the general and special representation of health care organizations, including national health care provider, health systems, hospitals, single- and multi-specialty physician groups, home health agencies, nursing homes, local and national ancillary service providers, and other health care providers and suppliers. A significant part of Tim’s practice focuses on representing health care companies in various merger, acquisition, divestiture and other significant business transactions, corporate finance, and corporate counseling. Tim has represented clients in numerous significant transactions, many for which he served as the lead transaction counsel.

Tim has significant experience in dealing with multi-state and federal regulations, including corporate practice of medicine requirements, state licensure standards, and retention requirements, Medicare and Medicaid Program participation requirements, government fraud and abuse laws; HIPAA privacy requirement, health system governance, and other general corporate matters. A significant part of Tim’s business involves representing both local and national providers in their merger, acquisition, sales, joint venture, and affiliation strategies. Clients have found Tim’s accounting background invaluable in structuring arrangements that are successful from both a legal and a business perspective.

Tim is a Certified Public Accountant, and prior to becoming an attorney, he was also director of corporate finance for a major health care provider in the Chicago metropolitan area. He previously taught Health Law and Nonprofit Law at IIT Kent College of Law in Chicago, Illinois, and Saint Mary’s University in Minneapolis, Minnesota.

Experience

  • Representing local and national health care companies in addressing both federal and state health care licensure and other requirements
  • Regularly represents both buyer and sellers on successful completion on both their local and national acquisitions or divestitures
  • Counsels health care providers on both federal and state fraud and abuse laws including the federal Anti-kickback Statute and the Stark law
  • Assists providers in responding to requests for information from regulators on regulatory issues
  • Provides assistance in developing and structuring joint venture arrangements that both meets the parties’ objectives and complies with the myriad of state and federal laws
  • Provides ongoing counsel and advice to providers in all health care areas
