Jason Thibodeaux focuses his practice in the areas of commercial finance, and banking and consumer financial services regulatory compliance. 

In his commercial practice, Jason represents banks, hedge funds, private capital lenders, REITs, institutional investment groups, and other institutional lenders in a wide range of commercial and financial transactions. In particular, Jason has significant experience representing secured and unsecured creditors in a variety of bankruptcy proceedings, including adversary actions, lift-stay, preference and fraudulent transfer actions, and plans of reorganization. Additionally, Jason routinely represents financial institutions and non-bank lenders in all aspects of commercial financing, with a particular emphasis in restructuring under-performing and non-performing financial assets.

In his regulatory and compliance practice, Jason advises financial institutions, non-bank lenders, mortgage servicers, marketplace lenders, automotive and personal property finance companies, and education lenders and servicers nationwide on compliance with state and federal laws and regulations governing the banking and consumer financial services industries. Jason has particular experience assisting lenders and servicers with regulatory compliance of state and federal lending laws, mortgage servicing regulations, consumer credit laws, licensing, debt collection laws, and state and federal UDAAP statutes.

Experience

Commercial Finance

  • Represents lenders in loan workouts, restructurings, bankruptcy, banking litigation, insolvency, receiverships, liquidations, and other distress transactions
  • Negotiates, structures, and documents a wide range of credit relationships, including working capital lines of credit, revolving loan facilities, term loans, and asset-based lending, as well as syndicated and participated financing transactions
  • Advises lenders regarding the sale and purchase of loans, and other secondary market transaction

Consumer Financial Services Regulatory Compliance

  • Represents and advises banks, other financial institutions, servicers, and finance companies in compliance matters involving the Truth in Lending Act (TILA), Fair Debt Collection Practices Act (FDCPA), the Equal Credit Opportunity Act (ECOA), Fair Credit Reporting Act (FCRA), and the Real Estate Settlement Procedures Act (RESPA)
  • Advises payment card products and issuers, including stored-value and gift cards, on compliance with state unclaimed property laws
  • Represents and advises clients in related federal and state examinations, investigations, and enforcement actions
